Using this site, the method, and the name.

Three different things with three different rules. The method is free to read and implement. The name is not free to use. Everything else is licensed.

1. Who and what

This site is operated by Closing Foundry Ltd, registered in England and Wales, company number 14629519. By using it you accept these terms.

These terms cover the site, the published method and the free assessment. They do not replace a signed licence agreement. Where an institution has one, that agreement governs its use and prevails over anything here.

2. The method licence

The published measurement method, comprising the model, the scales, the arithmetic, the bands and the version record, is free to read, implement and administer, including commercially, at no cost and without asking us.

The name is the thing that is protected. Only an implementation that returns the expected output for every published conformance vector at a stated version may describe its output as a Growth Score. If your implementation does not pass the vectors, call it something else.

You may not modify the questions, scales, arithmetic or bands and continue to use the name. Comparability is the entire value of the measure, and a modified implementation carrying the same name destroys it for everyone.

Not published, and not covered by this licence: the diagnostic library, the action and routing logic, the lens rule precedence, the confidence thresholds, the reporting layer, and the register of results.

3. What this is not

Not advice. The Growth Score is a measurement instrument. It is not financial, legal, investment or professional advice, and decisions you take remain yours
Not a credit or risk assessment. It must not be used as an input to lending, affordability, pricing, insurance, eligibility or employment decisions, or any decision producing legal or similarly significant effects for a person or business
Not verified data. It is what a company reports about itself, and every result says so
Not a prediction. It measures conditions upstream of growth and whether they are improving. It does not forecast growth, funding or any other outcome

4. Taking the assessment

It is free, and it stays free. There is no upgrade, no paywalled result and no charge at any point to the company being measured.

Answer honestly. A flattering answer set produces a flattering number and no movement at the rescore, which is the only part anyone downstream cares about.

You may share your own result with anyone you choose. We will not share it with an institution unless you consent.

5. Acceptable use

Do not attempt to reverse engineer the unpublished layers, scrape the site at volume, submit assessments on behalf of companies without their knowledge, misrepresent a result, present an unverified or modified output as a Growth Score, or use the site unlawfully.

6. Intellectual property

The method is published under the licence in section 2. Everything else, including the diagnostic content, the reporting, the software and the name, remains ours. Nothing on this site transfers ownership of anything.

7. Availability

The site and the free assessment are provided as they are, without warranty of uninterrupted availability. Service levels for licensees are in their agreement.

8. Liability

We do not exclude liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

Subject to that, and to the fullest extent the law allows, we are not liable for loss of profit, revenue, business, goodwill, or any indirect or consequential loss arising from use of this site, the free assessment or the published method. Our total liability in connection with free use of this site or the assessment is limited to amount to confirm.

9. Changes and law

We may update these terms and will show a new date here. Superseded method versions remain published at their own permanent addresses regardless.

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
